An arrangement to settle a certified class action concerning underpayment of certain disability pension payments administered by VAC has been granted by the Federal Court. From January 1, 2003, until December 31, 2023, the benefits were due to current and past members of the Royal Canadian Mounted Police and the Canadian Armed Forces, as well as their survivors.
On behalf of more than 330,000 Class Members who benefited from the benefits, the Representative Plaintiffs initiated the action. The main accusation is that VAC improperly indexed payments for inflation, resulting in an incorrect calculation of benefits between January 1, 2003, and December 31, 2023. Veterans Pension Settlement 2025
On January 17, 2024, the Federal Court approved Veterans Pension Settlement 2025 involving the alleged underpaid of certain disability pension by VAC to RCMP people or former members, as well as their spouses, CLP, survivors. If you have a current payment connection with VAC and earned disability pension payments at any point between 2003 and 2023, you will automatically receive your settlement payment by using your existing payment method. If surviving wives or dependent children of dead RCMP members earned disability pension payments independently at any point between 2003 and 2023, they may also be considered class members. They will also get their Veterans Pension Settlement 2025 Payment Amount in sometime.
Eligibility Requirements
The RCMP and personnel of the Canadian Armed Forces, both past and present, receive significant financial benefits from VAC disability pension settlement. This program is available to those courageous people as well as their spouses and dependents. It specifically targets people who have been eligible for Veterans Affairs Canada’s disability pensions, disability payments, and various additional benefits since 2002. According to the settlement, the basic pension was impacted by the yearly modifications under a number of laws and regulations.
According to the Agreement, Class Members will get a one-time payment equal to around 2% of the entire value of their impacted benefits that they received between January 1, 2003, and December 31, 2023. How to Apply?
- A written Claim must be submitted by March 19, 2025, by estates, surviving family members of dead Class Members, and other Class Members who do not already receive disability payments directly from VA.
- A claimant can file a claim online at veteranspensionsettlement.kpmg.ca, the Administrator’s website run by KPMG. Enter your personal and service details in the claim form and make sure to fill out the form completely to prevent errors.
- Present the required paperwork as proof of your eligibility and the amount of your payment. Add any necessary papers, such as pension records or benefit statements and submit it.
Amount and Deadline to apply for Claim
- A payout equal to approximately two percent of all associated benefits received by each class member between January 2003 and December 2023 is available to them. This will be used to cover the legal expenses.
- Approximately half of the class members received up to $1,000.00, whereas the average settlement payment for all applicants in the class is approximately $2,000.00.
- Everyone in the class who qualifies for this payment has to be ready to get paid. Those currently receiving disability pensions will be eligible for this payment by default. Those without benefits have until March 19, 2025, to submit a claim.
- You must file a claim with KPMG, the class action administrator, if you were receiving disability pension benefits at any point between 2003 and 2023 and you are no longer getting VAC payments.
- Claims must be made to the Class Action Administrator, KPMG, by the executor, estate trustee, administrator, family member, or relative of a dead RCMP Class Member who received VAC-disability pension benefits during that time.
- Family members may be eligible for a settlement payment for deceased dependents of former RCMP members, such as a spouse or dependent child who earned a disability pension in their own right, in addition to being entitled to the settlement amount of a deceased RCMP member. Please be aware that each member of the class will require a different claim form to be completed.
